By accessing, browsing, or using the Website, you (“you” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Website.

These Terms are intended to be read together with our Privacy Policy, available on the Website. Our Privacy Policy describes how we collect, use, and protect your personal information. By using the Website, you also agree to the terms of our Privacy Policy, which is incorporated into these Terms by reference.

No Account Required

The Website does not require you to create an account or log in to access content or purchase services. We do not perform identity or age verification.

Resource Pages

The Website includes resource pages and a Products tab containing affiliate and other links to pet supplements and foods, pet health devices, people food items for recipes, and clothing and household items. When you click a product link—including links to our Standard Process storefront—you are redirected to a third-party website where the purchase is processed and fulfilled entirely by that third party. Quantum Vibrant Wellness LLC does not sell, ship, handle, store, or take possession of any physical product. These resource pages and product links may contain affiliate links, as described in the Affiliate Links, Advertising, and FTC Compliance section of these Terms.

Paid Consultation Services

We offer three tiers of paid consultation services:

• 1–2 Question Email Q&A: You may submit one to two questions via email. We will respond within 24–48 hours, with approximately 10–15 minutes allotted to answer your questions. If your questions require more detail than can be addressed within this tier, we will provide whatever useful information she can and recommend that you book a 15- or 30-minute consultation for a more comprehensive discussion. This tier may also be used for follow-up questions arising from a prior 15- or 30-minute consultation.

• 15-Minute Consultation: A live video or phone consultation with us lasting approximately 15 minutes. After the consultation, we will document the discussion and send you a summary via a Word document or follow-up email.

• 30-Minute Consultation: A live video or phone consultation with us, lasting approximately 30 minutes. This tier is designed for more complex issues or situations involving multiple questions. After the consultation, we will document the discussion and send you a summary via a Word document or follow-up email.

Blogs and Resources

The Website features a Well Living blog that includes content on recipes, hiking, menopause, skin care, and related topics. This content is shared from our personal experience and does NOT constitute human medical advice. Please see the Veterinary and Service Disclaimers section for important disclaimers.

The Website also includes travel-related blog content and resource pages, including recommendations for toiletry containers, bags, cases, and clothing.

Future Services

Any new features or services added to the Website will be subject to these Terms.

Geographic Restrictions and Veterinary Licensing

Licensed Veterinary Telemedicine

Dr. Lisa Michelle Brienen, DVM, CVH, holds active veterinary licenses in the states of Washington and Idaho. Pet-specific telemedicine consultations—including consultations in which Dr. Brienen may prescribe homeopathic medicines—are available only to residents of Washington and Idaho.

General Educational and Informational Content

General educational and informational content, including articles, blog posts, and resource pages, is available to users in the United States and worldwide. General educational consultations that do not involve patient-specific veterinary advice are also available to users regardless of location.

Consultations Outside Washington and Idaho

Consultation may be offered to users outside of Washington and Idaho only in situations where the client’s primary veterinarian consults directly with Dr. Brienen. In such cases, Dr. Brienen acts in a consulting capacity at the request of the primary treating veterinarian.

Homeopathy and Veterinary Medicine

The practice of homeopathy for animals constitutes the practice of veterinary medicine in all states except South Carolina and Mississippi. Users are responsible for understanding the laws of their own jurisdiction before purchasing services.

Veterinary and Service Disclaimers

No Veterinarian-Client-Patient Relationship

Unless you are a resident of Washington or Idaho receiving a licensed telemedicine consultation, the services provided through this Website do not establish a veterinarian-client-patient relationship (“VCPR”). You are required to have an existing primary care veterinarian for your animal(s). The information and guidance provided through our consultations is educational in nature and is not a substitute for an in-person veterinary examination.

Scope of Prescribing

For consultations with residents of Washington and Idaho, we may prescribe homeopathic medicines if doing so is within the scope of the consultation. We will NOT prescribe, fill, or alter allopathic medication prescriptions, and we will not authorize veterinary diets unless a physical VCPR has been established.

Education-Focused Platform

This Website is primarily an education-focused platform. Except as part of licensed telemedicine consultations in Washington and Idaho, the Website does not provide formal veterinary diagnoses or treatment plans.

Not an Emergency Service

THE SERVICES OFFERED THROUGH THIS WEBSITE ARE NOT AN EMERGENCY SERVICE. We do not offer services for veterinary emergencies, the primary treatment of cancer, or life-threatening or severe autoimmune disease. These conditions are best handled through in-person veterinary care. If your animal is experiencing a medical emergency, please contact your local emergency veterinary clinic immediately.

Limitations of Remote Consulting

Remote consulting has inherent limitations. We cannot physically examine your animal, palpate, listen to vital organs, or run diagnostic tests during a remote consultation. The information you provide during a consultation directly affects the quality and accuracy of any guidance given.

Right to Terminate and Refer

We reserve the right to terminate a consultation session at any time and refer you to an emergency veterinary clinic or your primary care veterinarian if we determine that your animal’s condition requires immediate in-person care or is beyond the scope of a remote consultation.

No Guarantee of Outcome

We do not guarantee any particular cure, improvement, or outcome from our consultation services. Every animal is unique, and results may vary.

User Assumes Risk of Delay

We are not liable for any delay in treatment or worsening of your animal’s condition that results from your decision to pursue an online consultation instead of seeking immediate physical veterinary care.

Well Living Content Disclaimer

Content published under the “Well Living” category of the Website—including content about menopause, skin issues, recipes, hiking, and general wellness—is shared from our personal experience. This content does NOT constitute human medical advice, and it should not be relied upon as a substitute for consultation with a qualified human healthcare provider.

Authorized Agents

An authorized agent—such as a pet sitter, family member, or other person designated by the pet owner—may book and participate in a consultation on behalf of the pet owner. The authorized agent is responsible for accurately communicating relevant information about the animal and relaying any guidance to the pet owner.

Payment Terms

Pricing

All prices are in U.S. dollars and are subject to change. We will post any pricing changes on the Website prior to their taking effect.

Payment Collection

Payment is collected at the time of booking. You must complete payment before your consultation is confirmed.

Accepted Payment Methods

We accept credit and debit card payments processed through Elavon. We do not accept cash, checks, or other forms of payment at this time.

Confirmation and Receipt

After booking and payment, you will receive an automated confirmation email and receipt.

No Subscriptions or Memberships

We do not offer subscription or membership models. Each consultation is a standalone purchase.

No Overage Charges

We do not charge per-minute overage fees. If a consultation does not fully address your questions, follow-up is handled by purchasing an additional service tier (e.g., a 1–2 Question Email Q&A for follow-up questions, or a 15- or 30-minute consultation for more in-depth discussion).

Cancellation, No-Show, and Refund Policy

Cancellations

You must provide at least forty-eight (48) hours’ notice to cancel a scheduled consultation. Cancellations made with at least 48 hours’ notice will be rescheduled at no additional charge. There is no cancellation fee.

Missed Appointments (No-Shows)

If you fail to attend a scheduled consultation without providing advance notice, no penalty will apply for your first missed appointment and we will work with you to reschedule. For any subsequent missed appointment, a no-show fee will apply.

Refunds

Refunds may be offered in select circumstances at our sole discretion. To request a refund, please contact us at lisa@quantumvibrant.com.

No Additional Fees

There are no additional fees beyond the service tier pricing listed above. Follow-up inquiries require the purchase of a separate service tier.

Affiliate Links, Advertising, and FTC Compliance

Affiliate Relationships

The Website may include affiliate links to third-party products and services. When you click on an affiliate link on the Website and make a purchase, we may earn a percentage commission on the sale. This compensation does not affect the price you pay for any product.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR ANY CONSULTATION SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SPECIFIC CONSULTATION GIVING RISE TO THE CLAIM. THIS CAP APPLIES TO QUANTUM VIBRANT WELLNESS LLC AND DR. LISA MICHELLE BRIENEN, DVM, CVH, INDIVIDUALLY AND COLLECTIVELY.

Exclusion of Damages

IN NO EVENT SHALL WE BE LIABLE FOR CONSEQUENTIAL DAMAGES, INCIDENTAL DAMAGES, LOST PROFITS OR REVENUE, EMOTIONAL DISTRESS, VETERINARY COSTS INCURRED AFTER A CONSULTATION, OR ANY OTHER INDIRECT, SPECIAL, OR PUNITIVE DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED.

Indemnification

You agree to indemnify, defend, and hold harmless Quantum Vibrant Wellness LLC, Dr. Lisa Michelle Brienen, DVM, CVH, and their respective officers, agents, and successors (the “Indemnified Parties”) from all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use or misuse of the Website or consultation services, your violation of these Terms or any applicable law, any false, inaccurate, or misleading information you provide during a consultation, or your reliance on information obtained through the Website or a consultation in lieu of seeking immediate veterinary or medical care.

Dispute Resolution and Governing Law

Governing Law

These Terms and any dispute arising out of or relating to these Terms, the Website, or any consultation services (each, a “Dispute”) shall be governed by the laws of the State of Idaho, without regard to its conflict-of-law principles.

Informal Resolution

Before initiating any formal proceeding, you agree to contact us at lisa@quantumvibrant.com and attempt to resolve the Dispute informally for at least thirty (30) days.

Mediation

If informal resolution fails, either party may initiate mediation in Bannock County, Idaho, before a mutually agreed-upon mediator. The parties shall share mediation costs equally.

Binding Arbitration

If mediation does not resolve the Dispute, either party may submit it to binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration shall take place in Bannock County, Idaho, unless the parties agree otherwise. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

No Litigation

Disputes shall be resolved exclusively through the mediation and arbitration procedures above, and not through litigation, except as necessary to enforce an arbitration award.

Class Action Waiver

ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION AGAINST US.

Limitation on Time to File Claims

Any claim arising out of a Dispute must be filed within one (1) year after the event giving rise to the claim. Claims not brought within this period are permanently barred to the fullest extent permitted by law.

Prevailing Party Attorney’s Fees

In any proceeding to enforce these Terms, the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs from the other party.

Termination and Suspension

We reserve the right, in our sole discretion, to terminate or suspend your access to the Website and its services, without prior notice, for violating these Terms of Service, engaging in abusive, harassing, or threatening behavior, providing false or misleading information, misusing the consultation services or the Website, misrepresenting Dr. Brienen, her credentials, or the Website, or any other conduct that we reasonably believe is harmful to the Website, its users, or Quantum Vibrant Wellness LLC.

Termination or suspension of your access does not waive any other rights or remedies available to us under these Terms or applicable law.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ALL CONTENT, SERVICES, AND CONSULTATION OFFERINGS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AS WELL AS ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
